Who We Are

D-Route Logistics, LLC d/b/a AggDirect, including its affiliates (“AggDirect,” “we,” “us,” or “our”), is an online logistics platform delivering solutions to and serving our Users based in the United States. Undefined capitalized terms used herein shall have the definitions as set forth in our Terms of Service.  

Application of this Privacy Policy

We have created this Privacy Policy to disclose our information collection, use and processing practices. We strongly recommend that you read this entire Privacy Policy before accessing or using the Services or conducting any activity or business through the Site. By accessing or using the Services you agree to be bound by and to comply with the terms and conditions of this Privacy Policy in addition to certain other agreements with AggDirect. Your use of the Services is also subject to and governed by our Terms of Services, which are to be read in conjunction with this policy. 

This Privacy Policy applies to any Users of our websites (including without limitation, www.droute.com, www.d-route.com and www.aggdirect.com), the AggDirect web and mobile application (“Mobile App” or “App”), software applications, features and related services (collectively, the “Service(s)”). This Privacy Policy explains how AggDirect collects, uses or otherwise processes information, including information that personally identifies you, as a User, through your use of the Services and other interactions and communications you have with us in connection with the Services. Further, this includes collection at the time you create or register for your AggDirect account, access or use the Sites, download the app, and when you otherwise use or interact with the Services or communications with us. 

This policy specifically applies to the following type of Users, among others who access or use the Services:

  • Truckers (motor carrier trucking companies, owner-operators, independent contractor operators, dispatchers and brokers)
  • Customers (contractors or other parties requesting trucks and other services for their projects) 
  • Owners and Delivery Recipients (e.g., project owners and property owners)
  • Delivery Partners (e.g., material suppliers and dumping sites)

This Privacy Policy also applies to those who provide information to AggDirect or in connection with access or use of the Services, or whose information AggDirect otherwise receives in connection with its services (such as contact information and location of parties to either receive deliveries or who have loads to be picked up).

AggDirect solely provides services to Users located within the United States. The data controller for the information you provide or that is collected through the Service is:

AggDirect uses third party products and services in connection with the delivery and functionality of the Service and, in some instances, may be subject to those third parties’ terms of services or limitations on the use, ownership and/or disclosure of certain information collected or shared through the use or integration of their products or service with the Service.  

Collection of Information

  1. Provided by You

We collect information you provide to us, including at such times you create, access, modify or log in to your account, use the Services and contact or otherwise communicate with us. 

For Users who are Truckers, we collect information that includes each operator’s name, driver’s license, date of birth, vehicle/equipment information, insurance, government identification information (e.g., U.S. Department of Transportation number), driving record, background, work authorization status, experience, training, certifications, permits, licenses, contracts, contacts and such other information communicated to us by you or necessary to comply with local, state and federal law. 

For Users who are Customers or other parties accessing or using the Services, the information we collect includes, but is not limited to: name, address, entity, delivery or pickup location, project, owner’s details, contracts, contacts, job details and requirements, services requested, materials, pricing, schedule, special instructions, agent or representative’s details, permits, certifications, licenses, site details, credentials, vehicle/equipment information and such other information you may provide or necessary to comply with local, state and federal law.  

Other information provided by Users may include: email address, phone number, address, login name and password, account profile, signature, photographs, payment deposit or bank account, demographic data, credentials, company or organizational details, dates/calendar and such other information you may provide.

  1. Collected Through Access or Use of the Services

We collect information through your access or use of the Services. Below are the general categories of information we collect, and this information may vary depending on the type of User you are: 

Device Information: We may collect information about the device you use to access or use the Services, including but not limited to: hardware, model, software, operating systems, browser, product numbers, preferences, access time, settings, serial numbers, file names, device identifiers, device components and component data, network and connectivity data, advertising data and such other information requested by or beneficial to the Services.

 Location, speed, email, name, medical card, insurance, dot number

Location Information: Use of the Services requires collection of certain location data. Precise or estimated location data may be collected from various sources, including for example your device (depending on your device and app settings and permissions), vehicle or equipment. Location data collected from your device may be collected when the app is running in the foreground or background. Also, we may calculate your precise or estimated location from sources that include your IP address, GPS, wireless connectivity, phone number or other sources in connection with you access and use of the Services. We may also receive information or determine your location from third parties. 

Communications Data:  We can communicate with Users, and in certain instances Users can communicate with each other, through the Services. We receive and collect information in connection with such communications, including the date and time and content of those communications. AggDirect may access or use this information for purposes that include facilitating performance of the services requested by a User, customer support, troubleshooting, problem solving, analytics, product modifications, to give notice, security, training and other purposes. 

Photographs: If you permit the app to access the camera on your device via the permission settings therein, we will enable you to take and upload to the Services photos of tickets, freight, bills of ladings, vehicles/equipment and other things in connection with the Services. 

Transaction Information: We collect information in connection with your use of our Services and transactions related to such use, including but not limited to the transaction type, services requested or provided, order data, pickup or delivery information, payment information, time, distance, mapping, special instructions, contract or project details, relevant parties and such other information related to or concerning the transaction.  

Usage Information: We collect information about how you use or interact with our Services. This may include information such as type of use, frequency of use, time of access, IP address, app pages and features used, settings, app performance data, source of access, third party services or sites used prior to accessing or using the Services and other usage data. We collect this information through cookies, special tags and other technologies and services that create and maintain unique identifiers.  

To disable AggDirect’s ability to collect your location data:

Please note that by turning off your device location data, you may interfere with, disrupt or prevent the Services from properly functioning, communicating or performing the requests made therein or thereby. In the event you disable the location data, you agree that you assume all risk, loss, liability, delays, damage, costs and other adverse impacts to your requests made through the Services, your business and your agreements with other parties. Further, you agree to indemnify, defend and hold harmless AggDirect and AggDirect’s owners, directors, employees, advisors, agents, representatives, affiliates, partners, contractors and service providers (“AggDirect Representatives”).

  1. Received from Other Sources

Information from other sources may include:

  • Government and quasi-government entities, including legal authorities and agencies such as the Federal Motor Carrier Safety Administration or other regulatory bodies.
  • User provided information, including in connection with the Services.
  • Users requesting products and/or services for or on your behalf.
  • Users who are your authorized agents or representatives.
  • If you are a driver, information from your motor carrier or third parties.
  • Insurance providers.
  • Financial services providers, including payment systems providers and banks.
  • Legal services providers.
  • Business partners or service providers in connection with the Services, including transportation providers, suppliers, dumping facilities, contractors and subcontractors, brokers, dealers, among others. 
  • User feedback.
  • Users logged into your account. 
  • Publicly available sources.
  • Marketing service providers, social media and other third parties.
  • Technologies services providers, including for solutions and APIs accessed or used in connection with the Services (e.g., Google, AWS, etc.).

We may combine the information collected from collected or received from these sources with other information. 

DISCLAIMER: Disabling or turning off the application, your device, functionality, data or connectivity services may not result in disabling or limiting AggDirect’s ability to collect your data, including location data and may affect the performance of the Services. 

How We Use Your Information

Please note that we may use the information that we collect in connection with the Services, or as otherwise described herein, for purposes that include:

  • To enable, enhance and deliver the products and services we offer or develop.
  • To enable and facilitate communications between the Services, AggDirect, Users and other parties.
  • To enable transactions, including facilitating payments, third party services and other business purposes.   
  • To track vehicles, equipment, freight and other things used in connection with the Services.
  • To create or customize content.
  • To compile, analyze, monitor, sort and generate usage data and User data.
  • For research and development, including design, testing, analysis, troubleshooting, enhancement and product and service development.
  • For customer support.
  • To provide promotions or offer products and services or other communications from us. 
  • Business purposes, such as generating reports on industry or activity trends.
  • To help support, monitor or maintain safety, security and usability of our Services, including screening companies, operators and other parties, monitoring or protecting against fraud, monitoring and identifying User behavior (e.g., operators’ speed and driving). 
  • As may be required in connection with legal proceedings as well as other political, legislative and policy processes that relate to our company, products, service and industry.
  • To perform or facilitate our internal operations.

Unless you have opted out of these features where available, we may use your information in a variety of ways to communicate with you, such as through email, SMS, newsletters, RSS feeds, service announcements, about topics that include products, services, customer service, updates, service interruption, promotions, changes, surveys, news and our partners.

Sharing of Information

We may share the information we collect about you with our affiliates, subsidiaries, partners, service providers, Users or other third parties as described in this Privacy Policy, to enable our products, services, features and functionality, at your request (or with your consent) or as otherwise described at the time of collection or sharing, including but not limited to:

  • Affiliates/Subsidiaries/Partners: We may share your information with our other entities and partners for reasons that include to facilitate or enable the suite of the products, services or solutions we offer or develop, data processing, analytics or storage, or for other purposes.
  • Other Users: We may share your information with other users of the Services or third parties (e.g., Delivery Partners) who require, request or utilize such information in connection with our services. For example, if you are a Customer, we will share your information with Truckers and other parties in connection with the facilitating, enabling or performing your request made through our services. For example, if you are a Trucker, we may share your name, vehicle information, driver’s license, certifications, contact information or other information in connection with a request or requirement related to our services.  
  • Account Owners: If you use the account or profile of another party, we may share your usage and other information with the owner of that account or profile. 
  • Service Providers: We may share your information with third party service providers in connection with facilitating, enabling, delivering, developing, promotion or enhancing our products, services and solutions. These service providers include, but are not limited to, entities such as: credit card payment processors, logistics or mapping platforms, APIs, financial institutions, marketing and promotions, support services, background check providers, data storage providers, data analytics providers, research partners, vendors, fleet partners, freight partners (e.g., pickup, delivery, dumping, storage, etc.), professional services providers or other third parties. 
  • At Your Request/With Your Consent: We may share your information if you request or consent to the sharing. 
  • General Public: If you communicate with us through public forums, such as social media, blogs or rating sites, this communication (in part or in whole) may be viewed by the public and we may share it with the public. If you provide us with feedback, for example through surveys, comments and other means, we may share this communication (in part or in whole) with the public. 
  • Third Parties for Legal Process: We may share your information if we believe it is required by applicable law, regulation, legal process or other government authority. We may disclose your information when we believe, in our sole discretion, that it is appropriate to do so in connection with or to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce or protect our rights, interests, property, including pursuant to our agreements or policies or in the event of a claim or dispute in connection with your use of our services or solutions or relating to your account or transactions. 

Please note that this Privacy Policy does not cover any third party’s use or handling of your information, personal or otherwise, once it is shared. Rather, the privacy policies of the various third parties will govern. These entities or their servers or data processing or other partners may be located either inside or outside the United States, where the laws governing privacy may be substantially different. 

Cookies 

A “cookie” is a piece of data, or text file, stored on your computer, device or browser by apps, websites, files, emails, media, ads or other programs that tracks information about a user. AggDirect and our partners may use cookies and other identification technologies on our devices, apps, websites, emails and other solutions for purposes described in this Privacy Policy, including:

  • Analyzing usage and trends, including the behavior and patterns of those accessing or using the Services. 
  • Analyzing and sorting content.
  • Authenticating users.
  • Remembering user preferences and settings.
  • Analyzing other user information.

We may also work with and allow third parties to provide analytics and other solutions that may use cookies and other technologies to identify you, your device, when you access or use the Site and Services as well as other websites and services online. 

Generally, you should have the ability to accept or decline cookies depending on your device and browser. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies, if you prefer. If you choose to decline cookies, you may not be able to access or use, all or a portion of, the Site or the Services.

Log files

Information and data that is automatically collected from your browser when you visit the Site. This information includes: your IP address, your browser type, operating system, access times, the content of any present cookies (see “Cookies” above), and the referring website address. 

Links

The Services may provide or contain links to other websites. We are not responsible for the terms of use, privacy practices, contents and user agreement terms and conditions of these other websites, even if we provide a link to the website on or through the Services. We strongly encourage you to take notice of when you leave the App or Site and to review the privacy policies and user agreements of other websites you visit. 

Modifying, Deactivating or Deleting Your Account 

The Site gives users the option to change the information you provide and/or to not receive future communications related to the Site or Services. To change or edit the information you provide, please update your account information. To opt-out of receiving future information, please send us an email to the contact information provided below or follow the “opt-out” instructions provided in the communication(s) sent to you.  

If you create an account to access or use the Services, you may deactivate or delete such account by giving us notice either through the Site or the contact information provided below. We will deactivate or delete your account within a reasonable time, and you will be unable to access or use the Services. Thereafter, all or a portion, of the information collected, as provided in this Privacy Policy, will be retained by us and may be used for the purposes as set forth in this Privacy Policy. In the event that your account has an outstanding balance, open transaction or other administrative or financial matter, this may delay the deactivation or deletion of your account while the same is investigated and resolved. Any outstanding balance, open transaction or any other administrative or financial matter will continue to be investigated, processed, pursued or other appropriate action taken until properly resolved or closed even after your account is deactivated or deleted. 

Users and Visitors from Outside the United States

This Privacy Policy is only intended to cover the collection, use and sharing of information from residents or entities of the United States of America, and not those of any other jurisdiction. The data protection and other laws of the United States may be substantially different than those of jurisdictions outside of the United States. If you are visiting, accessing or using the Site and/or the Services from outside of the United States, please immediately refrain from doing so and exit the Site and/or Services. 

Privacy Policy Changes

AggDirect reserves the right to update or modify this Privacy Policy from time to time to reflect changes in our practices and the Services. We recommend that you periodically review this Privacy Policy to ensure that you are up-to-date on our policies. 

If any material changes are made in the way we collect, use and/or share your information, we will notify you through the Services, email or through other means, such as posting a notice and the updated Privacy Policy on the Sites. Your access or use of the Services thereafter indicates your consent to our changes to this Privacy Policy.
